General Terms and Conditions of Service for Crosstown Runzzz

1. Scope of Services
   Crosstown Runzzz offers on-demand and scheduled delivery services to customers within the designated service area. By using our services, customers agree to these Terms and Conditions, which are binding and govern all delivery transactions. Crosstown Runzzz reserves the right to modify these terms at any time, and such modifications will be effective upon posting on our website.
2. Service Availability and Limitations
   Crosstown Runzzz operates within specific geographic boundaries and reserves the right to decline delivery requests that fall outside these limits. Additionally, Crosstown Runzzz does not guarantee delivery of items that exceed size, weight, or volume limitations as determined by our discretion. Customers are responsible for ensuring that all items are adequately packaged for transport to prevent damage or harm.
3. Prohibited and Restricted Items
   For safety and compliance reasons, Crosstown Runzzz strictly prohibits the transportation of certain items, including but not limited to:

• Illegal Substances: Under no circumstances will Crosstown Runzzz transport illegal drugs, narcotics, or any other controlled substances prohibited by federal, state, or local law. This includes Marijuana, both medicinal and recreational, in accordance with Ohio State Law.  Violations will result in IMMEDIATE notification to law enforcement including but not limited to prosecution and individuals barred from future services.
• Alcohol: At this time, Crosstown Runzzz does NOT offer alcoholic beverage delivery for business or residential customers. However, we are working on the proper permits to supply alcohol delivery in the near future.
• Pharmacy Prescriptions: All pharmacy prescriptions MUST be signed for by the individual for whom the medication is prescribed OR an authorized family or staff member with proof of identity. Any prescription delivery that does not meet these requirements will be returned to the appropriate pharmacy.
• Combustible and Flammable Materials: Items such as gasoline, diesel, kerosene, propane, and other fuel types are prohibited. Pressurized items, including aerosols, spray paint, lighter fluid, are also restricted.
• Chemicals and Hazardous Substances: Transporting industrial chemicals, cleaning agents, pesticides, or any items deemed toxic, corrosive, explosive, or hazardous is STRICTLY PROHIBITED. Violations will result in IMMEDIATE notification to law enforcement including but not limited to prosecution and individuals barred from future services.
• Biomedical Waste and Hazardous Medical Materials: Crosstown Runzzz does not currently pickup or dispose of biomedical waste or hazardous materials from residential customers, including medical samples, needles, syringes, or any items that may pose a biohazard risk.
• Animals and Animal Products: Living or deceased animals are not eligible for delivery unless specific arrangements have been made in advance and authorization has been granted with written agreement

4. Packaging Requirements
   Customers are responsible for ensuring that all items are securely and appropriately packaged to withstand transport, handling and, in case of no-contact delivery, weather conditions. Crosstown Runzzz assumes no liability for damages resulting from inadequate packaging or mislabeled items. Fragile items must be clearly marked, and any item requiring special handling must be disclosed at the time of the delivery request.

• Labeling: All items MUST be properly labeled with recipient and return information. Including, but not limited to, Name, Address and working phone number.
• Value Disclosure: Any item with a value of $250.00 or more must be declared at time of request. Any item with a value of $500.00 or more must be approved by management. Crosstown Runzzz will not be liable for any item defined above if value is not disclosed at time of order.

5. Delivery Times and Service Level Guarantees
   While Crosstown Runzzz strives to meet all delivery timelines, specific delivery times are not guaranteed. Delivery times may vary based on traffic, weather, and other unforeseen conditions. Crosstown Runzzz is not liable for delays due to circumstances beyond our control, including but not limited to natural disasters, public health emergencies, or acts of government or climate.
6. Liability and Limits of Responsibility
   Crosstown Runzzz is not liable for damages, losses, or expenses arising from delayed or missed deliveries, except when caused by negligence. Crosstown Runzzz will not be responsible for damages resulting from lost, stolen, or damaged items if proper packaging and labeling guidelines have not been followed. Customers are encouraged to insure valuable items with their rental or home owners insurance for loss or damage. Customers assumes all responsibility for any items $100.00 or less and for the first $100.00 of any higher claim made if a value is declared at time of order.
7. Right to Refuse Service
   Crosstown Runzzz reserves the right to refuse service to any customer for reasons that include, but are not limited to, failure to comply with these terms, suspicion of illegal activity, inappropriate behavior toward employees, or risk to the health or safety of our staff. Crosstown Runzzz may also refuse delivery if the item is deemed non-compliant with our packaging, weight, or size restrictions. Crosstown Runzzz is not permitted to discriminate against any protected class or group of people based on federal guidelines.
8. Payment Terms
   All deliveries must be prepaid through the specified payment methods, unless alternative arrangements have been made in advance in writing.. Crosstown Runzzz reserves the right to charge additional fees for certain services, including but not limited to rush deliveries, after-hours pickups, and deliveries outside the standard service area. Any charges for special requests will be communicated upfront.
9. Refund and Cancellation Policy
   Cancellations must be made prior to 2 hours before scheduled pickup to be eligible for a full refund. If an item has already been picked up or is in transit, Crosstown Runzzz cannot offer a refund. If cancelation is requested after the 2 hour period, packages may be returned to sender without refund and may incur additional fees. In cases of service delays due to factors within Crosstown Runzzz’s control, customers may be eligible for partial refunds at Crosstown Runzzz’s discretion. Refund policies may vary based on specific services.
10. Compliance with Local, State, and Federal Laws
    Crosstown Runzzz complies with all applicable local, state, and federal regulations regarding the delivery of goods. Customers are responsible for ensuring that all items comply with these regulations before using our service. Crosstown Runzzz reserves the right to open and inspect any packages to ensure compliance with these Terms and Conditions or when required by law.
11. Personal Data and Privacy
    Customer information is handled according to our privacy policy. Crosstown Runzzz collects and stores personal information solely to facilitate delivery services and improve customer experience. We do not share or sell customer information to third parties, except when required by law or to protect the safety and rights of others.
12. Data Collection and Analytics
    Crosstown Runzzz reserves the right to collect and analyze statistical data on customer shopping habits and preferences. This may include demographic information, such as age, race, location, and other relevant factors, to help us better understand and serve our community. All data is collected and used in accordance with our privacy policy, and individual privacy will always be protected. Insights gained from this information may be used to improve our services, enhance customer experience, and tailor offerings to meet the needs of our customers.
13. Changes to Terms and Conditions
    Crosstown Runzzz may update these Terms and Conditions at any time. Customers will be notified of any substantial changes, which will take effect immediately upon posting to our website. Continued use of our services indicates acceptance of any revised terms.
14. Dispute Resolution
    Any disputes arising from or in connection with these Terms and Conditions or the services provided by Crosstown Runzzz will be resolved through binding arbitration, unless otherwise agreed. Customers waive the right to pursue legal claims in court, and any claims must be brought forward within one year of the disputed incident.
